Discussion on Regulatory Changes Crucial for Biomethane Development with POB’s Involvement

The Polish Biomethane Organization (POB) is actively participating in consultations on amendments to regulations governing the renewable energy market in Poland.

As part of the proposed amendments in the draft Act on the Promotion of Electricity Generation in Offshore Wind Farms and Certain Other Acts (o promowaniu wytwarzania energii elektrycznej w morskich farmach wiatrowych oraz niektórych innych ustaw), we have submitted a series of key comments to the Ministry of Climate and Environment. Our goal is to ensure the dynamic growth of the biomethane sector and establish stable and transparent regulations that support investment in this technology.

1. The Need to Clarify the Definition of Structures in Relation to Biogas and Biomethane Installations

We have proposed an amendment specifying that only the construction-related parts of technical equipment within biogas and biomethane installations should be classified as structures.
This clarification will eliminate existing uncertainties regarding the classification of such installations and provide investment stability.
The proposed change aligns with the amendments introduced in the Act of November 19, 2024, on Agricultural Tax, Local Taxes and Fees, and Stamp Duty (Journal of Laws of 2024, item 1757), which explicitly states that construction elements of technical equipment, including biogas and biomethane plants, are considered structures.

2. Expanding the Possibilities for Establishing Accelerated Development Areas for Biomethane Installations

The current draft legislation limits the designation of accelerated development areas, which may hinder the growth of installations utilizing agricultural biogas and biomethane—particularly in rural areas where local zoning plans are often absent.
We propose that such areas should also be designated based on mapped potential and legally binding zoning decisions allowing for the location of renewable energy installations.
This solution will increase the availability of land for investments while ensuring that planning decisions remain under the jurisdiction of regional and local authorities.

The Polish Biomethane Organization emphasizes the need to align the draft legislation with investment realities and the potential for biomethane development in Poland. The proposed changes will provide greater legal clarity for investors, facilitate the siting of biomethane installations, and accelerate the growth of the renewable energy sector in rural areas.
